Standard Terms & Conditions

 

By accepting this quotation, the Client agrees to the following terms:

1. Scope of Service
BPMC shall provide pest management services only for the pests, areas, and frequency specified in this quotation. Additional pests, areas, or services shall require a separate proposal and corresponding charges.

2. Service Delivery
Services shall be performed by qualified BPMC personnel during agreed schedules. Service reports and recommendations will be provided after each visit.

3. Client Responsibilities
The Client shall:

  • Provide safe and reasonable access to the service areas.
  • Provide water and electricity when necessary.
  • Follow BPMC's sanitation, housekeeping, exclusion, and safety recommendations.
  • Inform BPMC of any known site hazards before service.

Failure to implement recommended corrective actions may affect treatment effectiveness and void applicable service warranties.

4. Service Expectations & Warranty
Pest elimination is a process and may require multiple treatments depending on infestation severity. Complimentary callback services, when applicable, are limited to pests covered under the service agreement and are subject to the Client's compliance with BPMC recommendations. Flying insects, rodents originating from external sources, termites (unless specifically contracted), and reinfestations caused by poor sanitation or structural deficiencies are excluded from warranty.

5. Fees & Payment
Invoices are payable according to the agreed payment terms. Overdue accounts shall incur 3% interest per month until fully paid. BPMC reserves the right to suspend services, warranties, and reports until all outstanding balances are settled. The Client shall also be responsible for reasonable collection, legal, and attorney's fees, where applicable.

BPMC may adjust service fees to reflect increases in labor, fuel, materials, taxes, regulatory requirements, or other operating costs affecting service delivery. The Client shall be given at least sixty (60) days' prior written notice of any fee adjustment.

6. Suspension of Services
BPMC reserves the right to suspend or withhold scheduled services, reports, warranties, and callback visits until all outstanding accounts have been settled.

7. Term & Termination
This agreement shall remain effective for the agreed service period. Either party may terminate the agreement by providing thirty (30) days written notice, subject to the settlement of all outstanding obligations.

8. Limitation of Liability
BPMC shall exercise reasonable care and professional diligence in providing its services. However, pest management results are dependent upon sanitation, structural conditions, and the Client's compliance with recommendations. BPMC's liability shall, to the maximum extent permitted by law, be limited to the value of the services provided under this agreement.

9. Force Majeure
BPMC shall not be liable for delays or failure to perform services due to causes beyond its reasonable control, including natural disasters, government actions, labor disputes, or the Client's inability to provide access.

10. Governing Law
This agreement shall be governed by the laws of the Republic of the Philippines. Any dispute arising from this agreement shall be subject to the exclusive jurisdiction of the appropriate courts in Makati City.

11. Data Privacy
Any personal information collected shall be processed in accordance with the Data Privacy Act of 2012 (Republic Act No. 10173) and used solely for purposes related to the delivery of BPMC's services.

Acceptance
Acceptance of this quotation or issuance of a Purchase Order shall constitute the Client's acceptance of these Terms and Conditions.
